Quick answer
Covered private-sector employees in the Philippines are entitled to overtime pay, holiday pay, and night shift differential when the conditions for each benefit are met. These benefits can apply together.
The usual minimums are:
Ordinary-day overtime: 125% of the basic hourly rate for work beyond eight hours.
Work on a regular holiday: 200% of the basic daily wage for the first eight hours. An eligible employee who does not work generally receives 100%.
Work on a special non-working day: 130% for the first eight hours, increasing to 150% if it is also the employee’s scheduled rest day.
Night shift differential: An additional 10% of the applicable hourly rate for hours worked between 10 p.m. and 6 a.m.
Coverage, attendance, the kind of holiday, and the employee’s actual duties matter. More favorable contractual or collective bargaining benefits must also be considered. Department of Labor and Employment
Who is covered?
These rules principally concern private-sector employees covered by the Labor Code’s working-time provisions. Probationary or project-based status does not, by itself, remove entitlement. Neither does receiving a monthly salary.
However, statutory exclusions include qualifying managerial employees and managerial staff, field personnel, dependent family members of the employer, domestic workers and persons in another’s personal service, and certain workers paid by results. An exclusion must fit the actual arrangement; a label in a contract is not enough. Separate laws may protect workers outside these provisions. lawphil.net
Managers and supervisors: examine actual duties
A managerial exemption depends on matters such as managing an establishment or department, regularly directing at least two employees, and having hiring or dismissal authority—or recommendations given particular weight.
Managerial staff have a separate test involving management-related duties, discretion and independent judgment, specified assistance or specialized work, and limits on unrelated duties.
In Peñaranda v. Baganga Plywood Corporation, G.R. No. 159577, May 3, 2006, the Supreme Court examined the worker’s responsibilities in finding him exempt as managerial staff. A “supervisor,” “officer,” or “team leader” designation should therefore prompt a review of duties, rather than an automatic conclusion about entitlement. Supreme Court E-Library
Small-business exemptions differ by benefit
For retail and service establishments, the thresholds are:
BenefitEstablishment-size exclusionStatutory regular-holiday payRegularly employs fewer than 10 workersStatutory night shift differentialRegularly employs not more than five workersOvertime and rest-day/special-day premium payNo equivalent general exemption merely because the establishment has fewer than 10 workers
These are benefit-specific rules. For example, a qualifying retail establishment with six employees may fall outside statutory holiday-pay coverage while remaining covered by night differential and overtime requirements. A contract or established benefit may still provide payment beyond the statutory minimum. nwpc.dole.gov.ph
How overtime pay works
Count compensable work beyond eight hours
For the ordinary arrangement, overtime is measured daily, not merely by the total hours worked that week.
Compensable time includes work the employer requires or permits. Necessary work performed with the employer’s or immediate supervisor’s knowledge can count, even without a completed overtime form.
A genuine meal break ordinarily does not count as work. Short rest breaks of five to 20 minutes count. Required waiting and interrupted breaks may also count, depending on whether the employee is actually free to use the time personally. lawphil.net
Follow reasonable overtime-approval procedures and preserve approvals. If approval is disputed, keep evidence of the assignment, the work performed, and the supervisor’s knowledge. Merely remaining logged in or staying at the premises does not establish every claimed overtime hour.
Undertime and a later day off do not erase overtime
Article 88 prohibits offsetting undertime on one day against overtime on another. Allowing leave on another day also does not, by itself, excuse payment of the required overtime compensation. lawphil.net
A valid compressed workweek is an exception
Under DOLE Advisory No. 02, series of 2004, a compliant, voluntary compressed workweek can redistribute working hours into fewer days without overtime premiums merely because a workday exceeds eight hours.
The arrangement must meet the advisory’s conditions, including applicable safety requirements and notice to DOLE. Under that framework, work beyond 12 hours a day or 48 hours a week attracts overtime premiums. Certain industries and hazardous work are excluded from the scheme.
A unilateral announcement that everyone will work longer days is not enough to establish a valid exception. Special working-hour rules also apply to qualifying hospital and clinic personnel. Supreme Court E-Library
Holiday pay: identify the type of day first
Check the law or proclamation covering the actual date and location. The terms “regular holiday,” “special non-working day,” and “special working day” have different payroll consequences.
Regular holidays
For an eligible covered employee:
No work: Generally 100% of the daily wage.
Work for the first eight hours: 200%.
Work when the holiday is also a scheduled rest day: 260%.
For an unworked regular holiday, attendance immediately before the holiday matters. An employee who worked or was on paid leave on the preceding workday generally qualifies. Unpaid absence immediately before the holiday may remove entitlement if the employee also does not work on the holiday.
If the immediately preceding day was a scheduled rest day or establishment non-working day, that day is not itself an absence. Look back to attendance or paid leave immediately before it. Department of Labor and Employment
For two successive regular holidays, an unpaid absence before the first can affect both. Working on the first holiday can restore entitlement to the second holiday’s pay under the implementing rules. Seasonal workers during an off-season and employees under particular shutdown or benefit arrangements may require separate assessment. nwpc.dole.gov.ph
Special non-working days
The general rule for an unworked special non-working day is no work, no pay, unless a favorable company policy, practice, agreement, or collective bargaining agreement provides payment.
Working attracts 130% for the first eight hours, or 150% when the special day is also the scheduled rest day. Overtime is paid on the applicable increased hourly rate. Bureau of Working Conditions
Special working days
A special working day is generally treated as an ordinary working day for wage purposes. The declaration alone does not create a holiday premium. Ordinary overtime, night differential, and any applicable rest-day entitlement still need to be assessed. Philippine Information Agency
When two regular holidays fall on one date
This differs from two consecutive holidays. An eligible employee generally receives 200% if the double regular holiday is unworked and 300% for the first eight hours if worked, with applicable additional premiums assessed separately.
In Asian Transmission Corporation v. Court of Appeals, the Supreme Court upheld the principle that two regular holidays coinciding on one date do not extinguish one holiday-pay entitlement. Check the specific DOLE advisory before computing an unusual overlap. elibrary.judiciary.gov.ph
Minimum pay rates when benefits overlap
The table assumes an employee covered by the relevant benefits, an ordinary eight-hour workday arrangement, and no higher contractual rates.
H means the basic hourly rate. For a straightforward eight-hour daily wage, H is the daily basic wage divided by eight.
Day workedRate for each of the first eight hoursRate for each overtime hourOrdinary working dayH × 1.00H × 1.25Scheduled rest dayH × 1.30H × 1.69Special non-working dayH × 1.30H × 1.69Special non-working day also falling on a rest dayH × 1.50H × 1.95Regular holidayH × 2.00H × 2.60Regular holiday also falling on a rest dayH × 2.60H × 3.38
These are total rates, not amounts to add again to an already-computed full rate. For example, regular-holiday overtime is H × 2.00 × 1.30, producing H × 2.60. Department of Labor and Employment
For monthly salaries, first establish the correct daily and hourly equivalents from the compensation arrangement. Do not automatically divide every monthly salary by 26 or 30. Review which days the salary already pays, the agreed divisor, and any applicable wage order or allowance treatment.
The Supreme Court’s decision in Odango v. NLRC, G.R. No. 147420, June 10, 2004, illustrates why the divisor and paid-day arrangement matter. Monthly-paid employees are not automatically excluded from holiday pay, but a payment already included in salary should not be counted twice. Supreme Court E-Library
How night shift differential is computed
For covered private-sector employees, night differential applies to compensable hours between 10 p.m. and 6 a.m., even when those hours are within the normal shift.
When the same hour also qualifies for overtime or a holiday/rest-day premium, compute the applicable hourly rate first, then add at least 10% of that rate:
Total pay for a qualifying night hour = applicable hourly rate × 1.10
Only qualifying hours receive the differential. A shift partly outside the statutory window does not receive night differential for its entire duration merely because it is called a “night shift.” lawphil.net
Illustrative calculations
Assume a basic daily wage of ₱800, making H ₱100. This is an example, not a statement of the applicable minimum wage.
SituationCalculationAmountTwo overtime hours on an ordinary day₱100 × 1.25 × 2₱250 overtime payEight hours worked on a regular holiday₱800 × 2.00₱1,600 totalSix ordinary, non-overtime hours within the night window₱100 × 0.10 × 6₱60 additional night differentialOne overtime hour within the night window on a regular holiday that is also a rest day₱100 × 2.00 × 1.30 × 1.30 × 1.10₱371.80 total for that hour
For the last example, multiplying the applicable factors matters. Simply adding 100%, 30%, 30%, and 10% would produce the wrong result.
What to do if your payslip appears incorrect
1. Prepare a dated breakdown
For each disputed day, record:
Shift start and end, breaks, and actual compensable hours.
Whether it was an ordinary day, rest day, or declared holiday.
Hours beyond eight and hours between 10 p.m. and 6 a.m.
Applicable wage rate, amount paid, and estimated shortfall.
Separate the claims so payroll can check each one.
2. Preserve evidence lawfully
Keep copies of employment terms, job descriptions, payslips, bank credits, schedules, time records, leave approvals, overtime instructions, and relevant messages or emails. Preserve original electronic records where possible, including timestamps and context.
For agency-deployed employees, keep duty orders and records from both the agency and the client workplace.
In G.R. No. 261716, decided October 9, 2024, the Supreme Court explained that employees generally must establish that overtime or holiday/rest-day work was actually performed. Once entitlement is established, evidence of payment becomes central. An employer’s custody of payroll records does not eliminate the need to identify the work being claimed. lawphil.net
3. Ask payroll or HR for a written explanation
Request the hourly rate, salary divisor, recorded hours, premium factors, and basis for any claimed exemption.
If the employer says premiums are “included in the package,” request an itemized reconciliation against the actual work rendered. A package description alone does not show whether the required amount was paid.
4. Seek assistance through SEnA
You can file a Request for Assistance, or RFA, through DOLE ARMS, the official online system.
Onsite filing is also available through participating DOLE regional/provincial offices, National Conciliation and Mediation Board offices, and National Labor Relations Commission offices. Save the acknowledgment and reference number. arms.dole.gov.ph
SEnA generally provides a 30-calendar-day conciliation-mediation process. The revised framework under Department Order No. 249, series of 2025, took effect on March 2, 2025. Either party may request early termination and referral to the appropriate office under Republic Act No. 10396.
Conciliation seeks a settlement; filing an RFA does not itself produce a judgment awarding money. Department of Labor and Employment
5. Confirm the proper forum if settlement fails
The route depends on the claim and employment circumstances:
DOLE’s inspection and enforcement powers may address labor-standard violations.
Article 129 provides a summary route for qualifying money claims totaling no more than ₱5,000 per employee, without a reinstatement claim.
Claims within Labor Arbiter jurisdiction proceed through the NLRC’s arbitration system.
Disputes involving a collective bargaining agreement may require grievance machinery and voluntary arbitration.
₱5,000 is not a blanket ceiling on DOLE’s inspection-based enforcement powers. Ask the receiving officer to identify the correct referral. elibrary.judiciary.gov.ph
Filing deadlines and when help is urgent
Under Article 306, formerly Article 291, employment money claims generally must be filed within three years from when the cause of action accrued. For unpaid recurring benefits, assess when each payment became due; do not assume the period begins only upon resignation.
The effect of an RFA, written demand, or other proceeding on prescription requires examination of the applicable rules and dates. Do not rely on ongoing HR discussions to preserve every claim. lawphil.net
Seek prompt assistance from DOLE, your union, or a labor lawyer when:
Older unpaid amounts are approaching three years.
The employer is closing or access to records may disappear.
You face dismissal, threats, or pressure to alter time records.
You are asked to sign a quitclaim or settlement without a clear computation.
A termination dispute accompanies the unpaid-benefit claim.
Article 118 prohibits specified retaliation against employees who file complaints or participate in proceedings under the Labor Code’s wage provisions. Preserve any threats and report them with the underlying pay dispute. lawphil.net
Common mistakes to avoid
Treating every holiday as a double-pay day.
Applying ordinary overtime rates to holiday or rest-day overtime.
Adding premium percentages when the applicable factors must be multiplied.
Assuming a monthly salary or supervisory title automatically removes entitlement.
Treating every small establishment as exempt from every benefit.
Claiming an entire shift as night work without separating qualifying hours.
Waiting until resignation before documenting or pursuing unpaid amounts.
Frequently asked questions
Does Sunday work automatically attract extra pay?
No. Sunday attracts the usual rest-day premium when it is the employee’s scheduled rest day. If Sunday is an ordinary scheduled workday and the rest day falls elsewhere, Sunday alone does not create that premium. Special rules apply where the nature of the work prevents regular workdays and rest days from being scheduled. BLR - Bureau of Labor Relations
Do employees working from home retain these rights?
Yes, if covered. The Telecommuting Act, Republic Act No. 11165, requires applicable minimum labor standards and fair treatment, including overtime and night differential. Record actual work, instructions, and approvals just as you would onsite. lawphil.net
Can an employer require overtime during an emergency?
The Labor Code permits compulsory overtime in specified circumstances, including emergencies, urgent equipment work, preventing loss of perishable goods, and completing work necessary to prevent serious disruption. Required overtime remains payable; urgency does not make it free. lawphil.net
Are government employees subject to the same night differential rule?
No. Government employment has a separate framework. Republic Act No. 11701 and its implementing rules provide for covered personnel working between 6 p.m. and 6 a.m., at an agency-determined rate not exceeding 20%, subject to coverage and other conditions. Public health workers have additional protections. The rules exclude job-order and contract-of-service workers from that particular framework. Supreme Court E-Library
