Quick answer
Philippine law does not give every private-sector employee a separate, fixed number of paid sick-leave days. The usual statutory minimum is five days of paid service incentive leave (SIL) after at least one year of service, subject to exemptions. SIL may be used for sickness, vacation, or other leave purposes. A contract, collective bargaining agreement (CBA), or company policy may provide more generous sick-leave benefits. Department of Labor and Employment
Government employees generally have a different entitlement: 15 days of sick leave and 15 days of vacation leave annually, earned and accumulated under Civil Service rules. Special employment categories have separate rules. Supreme Court E-Library
Three questions must be considered separately: May you be absent? Will you receive pay or a sickness benefit? Can your employment lawfully be terminated? Having exhausted paid leave does not, by itself, establish a lawful ground for dismissal.
Private-sector sick leave: what the law requires
Service incentive leave is a shared five-day benefit
Article 95 of the Labor Code provides qualifying employees with five paid SIL days yearly. It does not provide five sick days plus another five vacation days.
For SIL, one year of service generally includes continuous or broken service within 12 months from the employee’s starting date, including authorised absences, weekly rest days, and paid regular holidays. Department of Labor and Employment
The principal exclusions include:
Establishments regularly employing fewer than 10 employees.
Employees already receiving the benefit or at least five days of paid vacation leave.
Managerial employees and qualifying managerial staff.
Field personnel falling within the legal exemption.
Government employees covered by Civil Service rules and persons in another’s personal service.
Establishments specifically exempted by the Secretary of Labor and Employment under Article 95.
Actual duties and working arrangements matter. In Auto Bus Transport Systems, Inc. v. Bautista, the Supreme Court explained that commission-based or task-based payment does not automatically exclude an employee from SIL. Whether working hours can be determined with reasonable certainty is significant. Department of Labor and Employment
Kasambahays have a separate entitlement. Section 29 of the Batas Kasambahay, Republic Act No. 10361, grants five paid SIL days after one year of service. Unlike ordinary Labor Code SIL, unused statutory kasambahay leave does not accumulate, carry over, or convert to cash. Supreme Court E-Library
Company benefits can exceed the minimum
Check your employment contract, handbook, CBA, and leave records. These may provide separate sick leave, hospitalisation leave, additional recovery time, or benefits available before the first employment anniversary.
An employer cannot assume that a benefit is freely withdrawable simply because it exceeds the statutory minimum. Contractual commitments and benefits that have become an established company practice may be protected against diminution. Whether a particular practice is legally enforceable depends on the evidence. Supreme Court E-Library
Unused statutory SIL is generally convertible to cash. However, separate company sick-leave credits do not automatically have the same conversion rules; examine the policy, CBA, and established practice. Supreme Court E-Library
SSS sickness benefit: income support during qualifying illness
SSS sickness benefit is a cash allowance for qualifying inability to work. It is separate from employer-paid leave and is not an automatic entitlement to 120 days of company-paid absence.
Eligibility and amount
Under Section 14 of Republic Act No. 11199, the main requirements include:
Inability to work because of sickness or injury, with hospital or approved home confinement lasting at least four days.
At least three monthly contributions within the 12 months immediately preceding the semester of sickness or injury.
Required notification.
Exhaustion of applicable paid sick leave.
SSS’s current guidance specifies current-year company sick leave and identifies an exception for sea-based OFWs. Supreme Court E-Library
The daily benefit is 90% of the average daily salary credit, not necessarily 90% of actual daily salary. The maximum is 120 days per calendar year, with unused days not carried forward. SSS applies a 240-day limit for the same illness, after which a continuing condition is considered for disability benefits, subject to evaluation. Supreme Court E-Library
Notification and filing deadlines
For locally employed members, the ordinary deadlines are:
SituationRequired actionHome confinementEmployee notifies employer within five calendar days after confinement starts.Employer receives home-confinement noticeEmployer notifies SSS within five calendar days after receipt.Hospital confinementEmployee’s SSS notification requirement is waived; employer notifies SSS within one year after discharge.Employer reimbursement: home confinementFile within one year from the start of confinement.Employer reimbursement: hospital confinementFile within one year after discharge.
The statutory employee-notification exception also covers sickness or injury occurring while working or within the employer’s premises. Nevertheless, promptly inform your supervisor or HR so your absence and claim are recorded. Late notification or filing can reduce or defeat benefits. Supreme Court E-Library
How the claim normally works
Submit medical evidence to your employer, which files the sickness notification through its My.SSS account. The employer ordinarily advances the benefit and seeks reimbursement. Self-employed, voluntary, and qualifying separated members follow the direct-application route. Consult the SSS sickness-benefit guide for required documents and applicable filing exceptions. sss.gov.ph
Under SSS Circular No. 2021-019, employees normally must confirm receipt of the advance within seven working days after SSS sends its email. Failure to confirm can cause rejection of the employer’s reimbursement application. Confirm only money actually received. sss.gov.ph
Government employees: sick leave and the 2026 wellness policy
Under the Civil Service leave rules, covered employees generally earn 15 days each of vacation and sick leave annually, with accumulation permitted. These are earned credits, not necessarily a full allocation available immediately upon appointment. Public-school teachers and personnel covered by special leave laws require separate assessment.
A contractual government appointment is also different from a contract-of-service or job-order engagement. COS and JO workers do not automatically receive ordinary Civil Service leave benefits. Their contracts and applicable issuances must be checked. Supreme Court E-Library
For ordinary government sick leave:
Notify the immediate supervisor or agency head.
File the prescribed application immediately upon returning.
Attach a medical certificate for more than five successive days.
Support an advance application for examination, surgery, or medically advised rest with a medical certificate.
A certificate may also be required for a shorter absence when there is doubt.
Properly supported sick leave must be approved in accordance with the rules; documentation must actually substantiate the absence. Supreme Court E-Library
Wellness leave effective 1 January 2026
CSC Memorandum Circular No. 1, series of 2026, authorises agencies, subject to agency discretion, to grant up to five wellness-leave days annually, separate from existing leave benefits.
The policy allows mental-health care, physical-wellness activities, or a general break. Normally, applications must be filed at least five days beforehand; emergencies may be filed immediately upon return. No more than three consecutive days may be taken at a time. Unused days neither accumulate nor convert to cash. COS and JO eligibility depends on their contracts and relevant issuances.
This is not a general five-day wellness-leave entitlement for private-sector employees. csc.gov.ph
Government employees on a compressed 10-hour workday should also check deductions: CSC’s 2026 guidance specifies 1.25 leave credits per day of absence under that schedule, while retaining the usual monthly accrual. csc.gov.ph
Special medical circumstances may have separate benefits
Surgery for a gynecological disorder
Section 18 of the Magna Carta of Women, Republic Act No. 9710, provides special paid leave following qualifying gynecological surgery for an employee with at least six months’ aggregate service during the preceding 12 months.
For private-sector implementation, the maximum is two months or 60 calendar days per year, with the medically certified recovery period determining the actual duration. It is not an automatic 60-day grant for every procedure. Supreme Court E-Library
Apply before planned surgery within the applicable reasonable notice period. Emergency surgery does not require a prior application, but the employer must be notified and the application completed afterward. Preserve the medical certificate, clinical summary, and surgical records. This employer-paid benefit is distinct from SSS sickness benefit; each has its own conditions. Supreme Court E-Library
Childbirth, miscarriage, or emergency termination of pregnancy
These fall under the Expanded Maternity Leave Law, Republic Act No. 11210:
105 calendar days for live childbirth.
15 additional paid days for a qualified solo parent.
60 calendar days for miscarriage or emergency termination of pregnancy.
An optional 30 additional unpaid days for live childbirth, normally requiring written notice at least 45 days before paid maternity leave ends; medical emergencies have a notice exception.
Private-sector payment involves SSS eligibility and employer salary-differential rules, including statutory exemptions. A pregnancy-related procedure following miscarriage should not automatically be classified as Magna Carta of Women surgical leave. Supreme Court E-Library
Illness or injury connected with work
The Employees’ Compensation Program may provide income, medical, and rehabilitation benefits for a compensable work-related condition. Claims run through SSS for covered private-sector workers and GSIS for covered government workers.
Unlike ordinary SSS sickness benefit, EC sickness benefit does not require exhaustion of paid leave credits. The general claim period is three years from accrual, with specific rules for determining that date. Report the incident promptly and preserve evidence connecting the condition to work. sss.gov.ph
Medical concerns arising from violence against women and their children
Qualified victim-survivors under Republic Act No. 9262 may receive up to 10 paid leave days, additional to other leave, and an extension where specified in a protection order. The implementing rules cover medical and legal concerns and require certification of the pending action from the appropriate barangay official, prosecutor, or court clerk. Supreme Court E-Library
Medical certificates, mental health, and privacy
An employer may request a medical certificate for legitimate leave or benefit processing. Do not assume that a certificate is unnecessary until the third day: a company’s applicable policy may require one earlier. The government’s five-day rule should not be treated as a universal private-sector rule.
Medical information must still be handled lawfully and proportionately. The National Privacy Commission’s guidance recognises legitimate certificate requests while requiring confidentiality safeguards and limiting information collection to what the purpose requires. Submit records through the designated HR or occupational-health channel rather than an office group chat. privacy.gov.ph
Mental-health conditions deserve the same careful assessment as physical illness. The Mental Health Act requires workplace policies addressing support, access to treatment, stigma, and discrimination. It does not itself establish a fixed additional paid mental-health-leave allowance for all private employees. Supreme Court E-Library
Where a condition qualifies as a disability, reasonable accommodation may be relevant—for example, appropriate schedule changes. The employer’s obligations depend on the employee’s condition, essential job functions, and the proposed accommodation. Supreme Court E-Library
Can an employee be dismissed because of illness?
Illness does not automatically justify dismissal. For private-sector termination on the ground of disease under Article 299, formerly Article 284, the employer must establish the statutory health-related ground and obtain certification from a competent public health authority that the disease cannot be cured within six months even with proper treatment.
A company doctor’s ordinary unfitness note should not simply be treated as satisfying that specific requirement. If the condition can be cured within the period, the implementing rule calls for leave and reinstatement to the former position upon restoration of normal health. This does not itself guarantee six months of employer-paid leave. Supreme Court E-Library
A lawful disease-based termination also requires:
Separation pay: at least one month’s salary or one-half month’s salary for every year of service, whichever is higher; a fraction of at least six months counts as one year.
Procedural compliance: DOLE Department Order No. 147-15 requires written notice to the employee and the appropriate DOLE Regional Office at least 30 days before termination.
An opportunity to respond: Supreme Court decisions also require notice of the proposed disease-based termination, an opportunity to be heard, and notice of the decision. Supreme Court E-Library
Specific anti-discrimination laws also apply. For example, Republic Act No. 11166 prohibits employment discrimination based wholly or partly on actual, perceived, or suspected HIV status. Supreme Court E-Library
Illness does not excuse every unrelated attendance violation or prevent every otherwise lawful termination. However, an employer must establish the actual ground and follow the applicable process. Government separation and disciplinary cases follow different Civil Service rules.
Practical steps when you need medical leave
Get appropriate medical care. Ask the treating professional to document the period of incapacity, recommended recovery, and relevant work restrictions.
Notify the employer promptly. Use the required channel and keep a dated copy. If incapacitated, ask someone to relay the information.
Identify the correct benefit. Ask whether the absence will use company sick leave, SIL, another statutory leave, or approved unpaid leave.
Check your balance and the written policy. Request an explanation of any deduction or denial.
Handle SSS or EC requirements separately. An approved company leave form is not proof that an insurance notification or claim was filed.
Arrange extensions before the approved period ends where possible. Submit updated evidence and request written confirmation.
Plan the return to work. Clarify any required medical clearance, restrictions, or accommodation.
Keep copies of:
Your contract, handbook, CBA, and relevant policy versions.
Leave balances, applications, approvals, and refusal messages.
Medical certificates, discharge summaries, and supporting test results.
Payslips, attendance records, contribution records, and benefit-payment evidence.
SSS transaction numbers, notices, and claim decisions.
Any return-to-work instruction, notice to explain, termination letter, or proposed quitclaim.
Common mistakes include waiting until recovery to notify the employer, assuming SSS will automatically pay full salary, treating a pending application as approved leave, ignoring a notice to explain, and signing a resignation or waiver without understanding it.
Where to seek help—and when it is urgent
For a private-sector leave or pay dispute, first request a written explanation from HR and use any applicable grievance procedure. You may seek assistance through DOLE’s Single Entry Approach, including the official DOLE ARMS portal, or an appropriate DOLE, NCMB, or NLRC office. SEnA generally provides a 30-day conciliation-mediation process; unresolved matters must proceed to the proper forum. arms.dole.gov.ph
Take benefit-processing disputes to SSS or GSIS, as applicable. Government employees should approach their agency HR office and the appropriate CSC office for the governing remedy.
Seek prompt legal or union assistance if you are threatened with dismissal during treatment, pressured to resign, denied return after medical clearance, accused of unauthorised absence despite submitted evidence, or approaching a claim or appeal deadline.
Ordinary employment money claims generally prescribe in three years, while illegal-dismissal actions generally prescribe in four years. Accrual rules—including those for unused SIL—and procedural deadlines can differ. Do not assume an internal HR complaint preserves every legal deadline. Supreme Court E-Library
Frequently asked questions
Do probationary employees have sick-leave rights?
Probationary status is not a blanket exclusion from all benefits. Ordinary SIL generally requires one year of service, but company leave, SSS coverage, and special statutory benefits have their own eligibility rules.
Can I claim SSS sickness benefit for a two-day illness?
Ordinarily, no: the minimum confinement requirement is four days. A shorter absence may still qualify for company sick leave or available SIL.
Can sick leave cover caring for a sick child or parent?
For private employees, check the company policy and any separately applicable parental-leave entitlement. SSS sickness benefit concerns the member’s own incapacity. Civil Service rules expressly allow sick leave for sickness or disability of an immediate-family member, subject to the prescribed proof and approval requirements. CSC Forum
What if I have no paid leave left?
Request documented unpaid leave or another applicable arrangement and check SSS or EC eligibility. Exhausting paid credits affects payment; it does not automatically establish a lawful basis for dismissal.
Does a medical certificate guarantee paid leave?
No. It supports the medical reason for absence. Paid entitlement still depends on the applicable law, available credits, policy, and claim requirements.
