Quick answer
Philippine law does not require every private employer to provide a separate annual allocation of paid sick leave. The general statutory minimum is five days of paid service incentive leave (SIL) after at least one year of service, subject to coverage exceptions. SIL may be used for illness, vacation, or other leave purposes. An employment contract, collective bargaining agreement (CBA), or company policy may provide more generous sick leave. The Supreme Court confirmed this distinction in Villafuerte v. Disc Contractors, Builders and General Services, Inc. Department of Labor and Employment
Government employees generally follow a different system: covered personnel earn 15 days of sick leave and 15 days of vacation leave annually. SSS sickness benefit is also separate: it is a cash benefit for qualified members, not an automatic entitlement to an equivalent period of employer-paid leave. Supreme Court E-Library
When you become ill, clarify three things with HR: whether your absence is authorized, which leave credits or benefits apply, and what documents and notifications are required.
Private-sector sick leave: what the law guarantees
Service incentive leave is the general minimum
Under Article 95 of the Labor Code, covered employees become entitled to five paid SIL days after completing at least one year of service.
For this purpose, one year generally means 12 months of service, continuous or broken, counted from the start of employment. Authorized absences and paid regular holidays are included. A shorter working year recognized by an agreement, policy, or established practice may qualify under the implementing rules. Unused statutory SIL is convertible to cash. Department of Labor and Employment
The rule has exceptions. These include:
Employees already receiving the statutory benefit or at least five days of paid vacation leave.
Employees of establishments regularly employing fewer than 10 employees.
Managerial employees and qualifying managerial staff.
Field personnel and other employees whose time and performance are unsupervised within the applicable rules.
Government employees and other categories excluded from the Labor Code provision.
The Code also recognizes exemptions granted by the Labor Secretary on specified grounds. An exemption from SIL does not automatically remove obligations under a separate contract or special law. nwpc.dole.gov.ph
Company sick leave can provide additional rights
Check your employment contract, handbook, CBA, and written leave policy. These may provide sick leave from hiring or regularization, additional days, carryover, or cash conversion.
Company sick leave is not automatically cash-convertible simply because statutory SIL is. The terms governing the particular benefit matter. Likewise, existing contractual or established benefits cannot simply be reduced by invoking the five-day statutory minimum; whether a particular benefit is protected depends on the agreement and relevant facts. Supreme Court E-Library
For example, an employee with a contractual sick-leave allocation should first examine that policy. An employee without separate sick leave should check SIL eligibility and any remaining credits.
Kasambahays have a separate statutory rule
Under Section 29 of Republic Act No. 10361, a kasambahay who completes one year of service receives five paid SIL days annually. Unlike ordinary Labor Code SIL, unused days under this provision do not accumulate, carry over, or convert to cash. Supreme Court E-Library
SSS sickness benefit: eligibility, payment, and deadlines
SSS sickness benefit can replace part of lost income during an approved period of incapacity. It does not require the illness to be work-related.
Who qualifies?
The usual requirements are:
Inability to work because of sickness or injury, with confinement at home or in a hospital for at least four days.
At least three monthly contributions during the 12 months immediately preceding the semester of sickness or injury.
Compliance with the applicable notification requirements.
For employed members, exhaustion of current company sick leave with pay for the year; SSS identifies an exception for sea-based OFWs. sss.gov.ph
A “semester” is the two consecutive quarters ending in the quarter when the sickness occurs. It is not simply the six months immediately before the first sick day. Ask HR or SSS to check the correct contribution window.
How much is payable?
The daily benefit is 90% of the member’s average daily salary credit, rather than 90% of actual daily take-home pay.
The limits are generally 120 days per calendar year, with no carryover of unused days, and 240 days for the same illness. A continuing condition may require disability-benefit evaluation. These limits do not guarantee approval of every requested day. sss.gov.ph
For employed members, the employer generally advances the sickness allowance and seeks SSS reimbursement. Section 14 of the Social Security Act provides for payment on regular paydays, or on the fifteenth and last day of the month, while benefits are due. Supreme Court E-Library
Notify promptly—even while collecting medical documents
The principal notification rules for employed members are:
SituationEmployee’s SSS-related notificationEmployer’s notification to SSSHome confinementWithin five calendar days after confinement startsWithin five calendar days after receiving the employee’s noticeHospital confinementEmployee-to-employer notification is not required for this SSS ruleWithin one year from hospital dischargeIllness or injury occurring while working or within company premisesEmployee notification is not required for this SSS ruleWithin five calendar days after onset
These exceptions concern SSS notification. Keep your supervisor or HR informed about your absence even when an SSS exception applies. sss.gov.ph
The employer’s reimbursement application generally must be filed within one year from the start of home confinement, or within one year from hospital discharge. Late notification or filing can reduce or defeat a claim. sss.gov.ph
What documents and filing steps are needed?
The official SSS sickness-benefit guide specifies a medical certificate stating the diagnosis, recommended leave and recuperation period, and the doctor’s identifying and contact details, together with supporting medical records. Employed members ordinarily submit these to their employer, which files through its My.SSS account.
For employer reimbursement, SSS generally requires the employee to confirm receipt of the advance payment within seven working days from the SSS email notification, subject to stated exceptions. Confirm only payments actually received. sss.gov.ph
Government employees: sick leave under Civil Service rules
Under the Omnibus Rules on Leave, covered appointive government personnel generally earn 15 days of paid sick leave and 15 days of paid vacation leave annually. Unused credits accumulate. Special rules apply to some personnel, including those under teachers’ leave or other statutory arrangements, so the standard allocation should not be assumed for every government engagement. csc.gov.ph
For ordinary sick leave:
Notify the immediate supervisor or agency head of the absence.
File the prescribed application immediately upon returning.
Submit a medical certificate for more than five successive days of sick leave.
Support an advance application for examination, surgery, or medically advised rest with a medical certificate.
The agency may also require a certificate for a shorter absence when there is doubt about its justification. Government sick leave can cover the employee’s illness or disability or that of an immediate family member. Supreme Court E-Library
The current CSC leave form also addresses an affidavit where medical consultation was not obtained. Ask HR how this applies to your circumstances rather than assuming that missing medical evidence can always be excused. csc.gov.ph
The separate government wellness-leave policy
Effective January 1, 2026, CSC Memorandum Circular No. 01, s. 2026 authorizes agencies, at their discretion, to grant up to five days of wellness leave, separate from existing leave allocations.
It permits no more than three consecutive days at a time. Applications generally must be filed at least five days beforehand, with an emergency exception. Unused wellness leave is forfeited at year-end and cannot be converted to cash. Contract-of-service and job-order workers’ entitlement depends on their contracts and applicable issuances. Check your agency’s implementation. csc.gov.ph
Medical situations with separate benefits
Surgery for gynecological disorders
Under the Magna Carta of Women and its implementing guidelines, qualifying women employees may receive up to two months, or 60 calendar days, of special leave with full pay following surgery for a gynecological disorder, subject to the prescribed recuperation period and annual limit.
The service requirement is at least six months of continuous aggregate employment during the preceding 12 months. PCW’s guidance distinguishes private-sector service with the employer from public-sector aggregate service across government agencies.
This is not a general leave entitlement for every illness affecting women. The surgery, medical certification, and eligibility requirements must be established. Apply before scheduled surgery; for emergency surgery, the application may be filed immediately upon return. See the Philippine Commission on Women’s official guidance. Philippine Commission on Women
Childbirth, miscarriage, and emergency termination of pregnancy
These events fall under the Expanded Maternity Leave Law. The statutory periods include 105 days for live childbirth and 60 days for miscarriage or emergency termination of pregnancy, with an additional 15 days for qualifying solo mothers.
Private-sector SSS eligibility and employer salary-differential rules must be checked separately. These absences should not automatically be charged as ordinary sick leave. Supreme Court E-Library
Work-related illness or injury
A work-related condition may qualify under the Employees’ Compensation Program, administered through SSS for covered private-sector workers and GSIS for covered government personnel. Report the incident or exposure and preserve evidence connecting it to work.
EC claims generally have a three-year prescriptive period, but the starting date depends on the contingency, and rules on previously filed SSS or GSIS claims can affect the calculation. Seek advice promptly instead of treating three years as a safe waiting period. ecc.gov.ph
Mental health conditions
DOLE’s workplace mental-health rules address nondiscrimination, confidentiality, treatment referrals, and appropriate work arrangements. Its supplemental guidance encourages additional paid leave and flexible arrangements for employees needing further care.
That guidance does not establish a universal fixed number of additional paid mental-health leave days for private employees. Check existing sick leave, SIL, SSS eligibility, and the employer’s mental-health policy. Department of Labor and Employment
Can an employer dismiss an employee because of illness?
Illness does not automatically justify dismissal, and exhausted leave credits do not by themselves establish a lawful ground for termination.
For disease-based termination under Article 299, formerly Article 284, of the Labor Code, continued employment must be prohibited by law or prejudicial to health under the statutory standard. The implementing rules additionally require certification by a competent public health authority that the disease cannot be cured within six months despite proper medical treatment.
If it can be cured within that period, the rule directs the employer to require leave instead of termination and to reinstate the employee to the former position upon restoration of normal health. This does not itself create six months of employer-paid leave. Department of Labor and Employment
A valid disease-based termination requires separation pay of at least:
One month’s salary; or
One-half month’s salary for every year of service,
whichever is higher. A service fraction of at least six months counts as a whole year. Department of Labor and Employment
Procedural fairness also matters. In Deoferio v. Intel Technology Philippines, Inc., the Supreme Court required written notice of the proposed ground, a reasonable opportunity to respond, and a subsequent written notice of the decision. Supreme Court E-Library
Absence is not automatically abandonment. Abandonment requires both unjustified failure to report and a clear intention to end the employment relationship. Preserve medical evidence and communications showing that you intend to return. Conversely, illness does not excuse unrelated misconduct or eliminate reasonable reporting requirements. elibrary.judiciary.gov.ph
Practical steps when you need sick or medical leave
Get appropriate medical care. Ask the doctor to identify the period of incapacity, expected recovery, and any work restrictions.
Notify your supervisor and HR promptly in writing. State when the absence started and your expected return, if known. If incapacitated, ask someone to notify them for you.
Ask which benefit applies. Request your leave balance and clarification on whether the absence will use sick leave, SIL, another statutory leave, or authorized unpaid leave.
Submit the correct documents and keep proof of receipt. Company approval and an SSS claim are separate processes.
Request an extension before the approved period ends where possible. Provide updated medical advice and ask for a written decision.
Clarify return-to-work arrangements. Ask whether a fitness certificate or temporary restrictions are needed.
Keep copies of:
Your contract, handbook, CBA, and applicable leave policy.
Leave applications, approvals, refusals, and balance records.
Medical certificates, test results, discharge summaries, and prescriptions.
Payslips, relevant SSS records, and claim reference numbers.
Emails, messages, attendance notices, and any disciplinary or termination documents.
Medical information is sensitive personal information under the Data Privacy Act. Employers must have a lawful basis for processing it and observe necessity, proportionality, and security. The National Privacy Commission has explained that access to full medical records may be disproportionate where a fitness certification would meet the purpose. Use the designated HR or medical channel for submissions. privacy.gov.ph
Common mistakes to avoid
Assuming every private employee automatically receives 15 paid sick-leave days.
Treating the SSS 120-day benefit ceiling as guaranteed employer-paid leave.
Waiting until recovery before notifying HR or checking SSS deadlines.
Assuming a medical certificate automatically approves every requested absence or benefit.
Treating all unused company leave as cash-convertible.
Ignoring a notice to explain or return-to-work instruction.
Signing a resignation, quitclaim, or settlement without understanding its effect.
If paid credits run out, request a written arrangement for the remaining recovery period. The questions of authorization, pay, benefits, and continued employment need separate answers.
Where to seek help—and when it is urgent
Seek prompt assistance if you are pressured to resign, dismissed because of illness without the required assessment, refused return after recovery, or approaching a benefit deadline.
For private-sector employment disputes, a practical starting point is a Request for Assistance under DOLE’s Single Entry Approach (SEnA). Requests may be filed through DOLE’s Assistance for Request Management System or appropriate DOLE, NCMB, or NLRC offices. SEnA generally provides a 30-day conciliation-mediation process; unresolved matters may require referral or formal proceedings. arms.dole.gov.ph
Direct SSS benefit questions to SSS. Government employees should use their agency’s HR and applicable CSC procedures. Union members should also check the CBA grievance process.
Do not delay a legal assessment: ordinary employment money claims generally prescribe in three years, while illegal-dismissal actions generally prescribe in four years. Accrual dates, interruption rules, and benefit-specific deadlines require separate examination. Supreme Court E-Library
Frequently asked questions
Can a probationary employee take paid sick leave?
Possibly. A company policy or contract may provide it before regularization. Statutory SIL generally requires one year of service; becoming regular is not, by itself, the statutory trigger. Department of Labor and Employment
Is hospitalization required for SSS sickness benefit?
No. Qualifying home confinement can also be covered. The contribution, incapacity, documentation, and notification requirements still apply. sss.gov.ph
Can an employer require a medical certificate for a one-day absence?
Check the applicable policy and circumstances. The CSC rule concerning absences exceeding five successive days is not a universal private-sector exemption from documentation. Even under CSC rules, a certificate may be required for a shorter absence when justification is in doubt. Supreme Court E-Library
Does taking care of a sick relative qualify as sick leave?
Government rules allow sick leave for illness or disability of an immediate family member. Private-sector employees should check their company policy and other applicable leave rights. SSS sickness benefit concerns the member’s own inability to work due to illness or injury. Supreme Court E-Library
Must I resign if my doctor recommends a long recovery?
No automatic resignation requirement follows from that recommendation. Ask about available leave, benefits, work adjustments, and the medical assessment needed for any proposed employment action. Disease-based termination has specific legal requirements. elibrary.judiciary.gov.ph
