Quick answer
Philippine employees are entitled to the labor protections that apply to their work, even if a contract or company handbook says otherwise. Employers may set reasonable workplace policies, but those policies must comply with law, applicable agreements, and employees’ protected rights. Signing a policy acknowledgment does not automatically make an unlawful provision enforceable.
For a particular employment question, check three things first: your actual employment status, the legal rule covering the benefit or action, and the relevant contract, policy, or collective bargaining agreement (CBA). Job titles and contract labels do not settle every issue.
This guide primarily addresses private-sector employment in the Philippines. Government service, overseas employment, seafaring, and domestic work have additional or different rules. The Labor Code recognizes workers’ rights to security of tenure, self-organization, collective bargaining, and humane working conditions. lawphil.net
Can company policy override employee rights?
A company policy cannot validly remove a statutory entitlement from an employee whom the law covers. For example, a handbook provision stating that covered employees receive no overtime pay cannot by itself defeat their legal entitlement.
Employers nevertheless have authority to manage operations, including work assignments, schedules, performance standards, and discipline. That authority has limits. In reviewing transfers, the Supreme Court has emphasized legitimate business purposes, good faith, and protection against unjustified demotion or reduction of compensation. A transfer used to punish or force out an employee may be unlawful, depending on the evidence. Supreme Court E-Library
When assessing a policy, ask:
- What does the law require? Identify the specific entitlement and its coverage rules.
- What do the documents promise? Read the employment contract, CBA, handbook, and later amendments together.
- What changed? Compare the old and new wording, effective dates, and actual payroll treatment.
- How was it applied? Preserve evidence of notice, explanation, and treatment of comparable situations.
Do not assume that every benefit may be withdrawn simply because it exceeds the legal minimum. Whether an existing benefit is protected against diminution can depend on its source, conditions, and history of payment. Conversely, an occasional or expressly conditional payment is not automatically a permanent entitlement.
Does being probationary, contractual, or a “freelancer” remove labor rights?
Employment status affects security of tenure and some benefits, but probationary employment is not a blanket exemption from labor standards.
Under Labor Code Articles 295–296, formerly Articles 280–281:
- Work usually necessary or desirable to the employer’s business generally supports regular employment, subject to recognized exceptions such as genuine project or seasonal employment.
- Probationary employment generally must not exceed six months from the date work starts, subject to applicable legal exceptions.
- A probationary employee may be terminated for a just cause or failure to meet reasonable regularization standards made known at engagement.
- An employee allowed to work after the probationary period generally becomes regular. Department of Labor and Employment
A “freelancer,” “consultant,” or “independent contractor” label should therefore be examined against the actual arrangement. If status is disputed, preserve instructions, reporting requirements, schedules, payment records, and evidence showing who controlled how the work was performed.
Likewise, repeated short contracts do not, by themselves, establish that every engagement was legally temporary. Have the contracts and actual duties assessed together.
What pay and working-time rights should employees check?
Minimum wage
There is no single minimum wage for every employee nationwide. Regional wage orders distinguish locations and may distinguish sectors, establishment sizes, or other classifications. Increases may also take effect in installments.
Use the National Wages and Productivity Commission’s official website to find the applicable regional wage order. Check the rate effective when the work was performed, rather than applying today’s rate to every earlier payroll period. Any claimed exemption should have an identifiable legal basis. The official website of the NWPC.
Hours, overtime, night work, and rest days
For employees covered by the Labor Code’s working-time provisions:
| Item | General rule |
|---|---|
| Normal working hours | Generally no more than eight hours daily |
| Ordinary-day overtime | At least an additional 25% of the hourly rate for work beyond eight hours |
| Night shift differential | At least an additional 10% of the regular hourly wage for covered work between 10 p.m. and 6 a.m. |
| Weekly rest | At least 24 consecutive hours after six consecutive normal workdays |
Coverage matters. Managerial employees, qualifying field personnel, and other legally excluded workers may fall outside particular provisions. A title such as “supervisor” does not, by itself, resolve the exemption. Department of Labor and Employment
Holiday and rest-day computations depend on the day’s legal classification, whether work was performed, and whether categories overlap. Covered employees working during the first eight hours of a regular holiday generally receive 200% of their basic wage. A special nonworking day generally follows “no work, no pay,” unless a favorable policy or agreement provides otherwise.
For covered private-sector rank-and-file employees who worked at least one month during the calendar year, minimum 13th-month pay is generally one-twelfth of basic salary earned that year, payable no later than December 24. Separation before December does not erase the proportionate entitlement. The DOLE statutory benefits handbook explains coverage, exclusions, and computations. Its historical wage tables should be checked against subsequent wage orders. nwpc.dole.gov.ph
Salary deductions
An employer cannot justify every deduction by calling it “company policy.” Labor Code Article 113 restricts wage deductions to legally permitted categories.
If payroll deducts an amount for shortages, damaged equipment, training costs, or an alleged debt, request the computation and legal basis. A signed document does not eliminate the need to assess whether the deduction itself is permitted. Department of Labor and Employment
What leave benefits may apply?
Leave eligibility varies by benefit. Regularization is not a universal prerequisite.
- Service incentive leave: Generally five paid days after one year of service for covered employees. Exceptions include employees already receiving at least five days of paid vacation leave and employees of establishments regularly employing fewer than ten workers.
- Paternity leave: Generally seven paid days for a married male employee for the first four deliveries, including miscarriage, of his legitimate spouse with whom he cohabits, subject to statutory conditions. nwpc.dole.gov.ph
- Maternity leave: The expanded maternity leave law provides 105 days for live childbirth, an additional 15 days for qualified solo mothers, and 60 days for miscarriage or emergency termination of pregnancy. For private-sector employees, payment involves SSS eligibility rules and employer salary-differential obligations, with legally recognized exemptions. An optional additional 30 days without pay is available for live childbirth under the law’s notice rules. lawphil.net
- Solo-parent leave: Qualified solo-parent employees with at least six months’ service may receive up to seven paid working days annually. This leave is noncumulative and forfeitable. The implementing rules identify a valid Solo Parent Identification Card as the documentary requirement for qualified employees. Supreme Court E-Library
Special leave may also apply to qualifying victims of violence against women and their children or to women undergoing qualifying surgery for gynecological disorders. Check the particular law and documentation requirements rather than treating all absences as ordinary vacation leave.
Can an employer change schedules, assignments, or work-from-home arrangements?
A workplace change requires an assessment of the employer’s business reasons, the employee’s agreement, and the practical effect.
For work from home, Republic Act No. 11165 allows private-sector telecommuting on a voluntary basis and on mutually agreed terms. It requires fair treatment and protection of applicable minimum labor standards. The law does not give every employee an unconditional right to demand permanent remote work. lawphil.net
Before accepting or challenging a change, obtain the written terms. Clarify working hours, reporting location, equipment responsibilities, performance measures, and any review or termination clause.
If a reassignment appears intended to make continued employment intolerable, seek advice before resigning or refusing instructions. Constructive dismissal depends on the circumstances; an inconvenient or unwelcome change does not automatically establish it.
What process is required before dismissal?
A company rule violation does not automatically justify dismissal. The employer must establish a legally sufficient ground and follow the procedure applicable to that ground.
Dismissal for just cause
For dismissal based on alleged employee wrongdoing, the required process generally includes:
- A written notice specifying the charges, supporting facts, and applicable grounds.
- A reasonable opportunity to explain—at least five calendar days from receipt of the notice—and a meaningful opportunity to present a defense.
- A written decision after the explanation and relevant circumstances have been considered.
A formal hearing is required in specified situations, including when the employee requests one in writing, substantial evidentiary disputes exist, or company rules require it. It is not mandatory in every case. These requirements are discussed in the Supreme Court’s decision in G.R. No. 225125. lawphil.net
Redundancy, retrenchment, closure, and other authorized causes
Authorized-cause termination follows different requirements. For redundancy, retrenchment, installation of labor-saving devices, and closure under Article 298, written notice generally must reach both the employee and DOLE at least one month before the intended termination.
Separation pay depends on the ground. Redundancy and labor-saving devices generally require at least one month’s pay or one month’s pay per year of service, whichever is higher. Retrenchment and qualifying closure generally require at least one month’s pay or one-half month’s pay per year, whichever is higher. Closure because of proven serious business losses has a statutory exception. Disease-related termination has separate requirements.
The stated reason must be substantiated; a notice or separation payment alone does not establish a valid termination. Department of Labor and Employment
What if the concern involves harassment or unsafe work?
Workplace sexual harassment
The Safe Spaces Act covers qualifying gender-based sexual harassment, including conduct between peers and conduct through electronic communications. Employers must maintain an independent internal complaint mechanism, observe due process, protect complainants against retaliation, and preserve confidentiality as far as possible.
The law directs the internal mechanism to investigate and decide complaints within ten days or less after receipt. Internal disciplinary proceedings do not necessarily replace other legal remedies. See the Philippine Commission on Women’s official guidance. lawphil.net
Dangerous working conditions
Republic Act No. 11058 recognizes rights to information about hazards, reporting of accidents and dangerous occurrences, and necessary protective equipment.
Its right to refuse unsafe work has specific conditions: DOLE must determine that an imminent-danger situation exists and the employer must have failed to undertake corrective action. It should not be read as an unrestricted right to refuse any task considered unsafe.
For immediate danger, move to safety, obtain emergency assistance as needed, and promptly notify the safety officer and DOLE. Preserve incident reports, photographs taken lawfully, and medical records. lawphil.net
What to do when a policy or employment action seems unlawful
1. Preserve relevant evidence
Keep lawful copies of:
- Contracts, job descriptions, regularization standards, and evaluations.
- The policy version involved and proof of when it was communicated.
- Payslips, time records, schedules, and relevant bank entries.
- Notices to explain, written responses, decisions, and termination notices.
- Relevant messages, leave requests, medical records, and witness details.
- Resignation, clearance, final-pay, and settlement documents.
Create a dated chronology. Preserve complete messages and original files where possible. Do not access restricted accounts or take unrelated confidential records.
2. Raise a specific written concern
Identify the policy or event, explain its effect, attach relevant records, and state the correction requested. Ask for the legal basis and computation where money is involved.
Use the grievance procedure or union assistance where applicable. Keep proof of submission and observe response deadlines even while questioning the process.
3. Use the appropriate assistance channel
Many employment disputes proceed through the Single Entry Approach (SEnA) before formal adjudication, subject to exceptions. Department Order No. 249, series of 2025, governs the revised process, which generally provides a 30-calendar-day conciliation-mediation period. SEnA facilitates settlement; it does not itself decide an illegal-dismissal case. Department of Labor and Employment
A Request for Assistance may be submitted through DOLE ARMS or onsite through the implementing DOLE, NCMB, or NLRC offices. Retain the reference number and follow conference instructions. arms.dole.gov.ph
If unresolved, obtain the proper referral. Illegal-dismissal disputes generally go to a Labor Arbiter; CBA interpretation disputes may belong in grievance machinery and voluntary arbitration. Benefit-remittance and other specialized complaints may require the responsible agency.
Deadlines and situations requiring urgent help
Seek prompt assistance if you receive a dismissal notice, face a short response deadline, experience threats or retaliation, or are being pressured to sign a resignation or quitclaim.
Important general periods include:
| Matter | General period |
|---|---|
| Ordinary employment money claims | Three years from accrual |
| Illegal-dismissal complaint | Four years from accrual |
| Unfair labor practice | One year from accrual |
Backwages resulting from illegal dismissal are treated differently from ordinary unpaid-wage claims. The Supreme Court explained that distinction in Arriola v. Pilipino Star Ngayon, G.R. No. 175689. lawphil.net
These periods are not permission to delay. Accrual, interruption, and the correct filing can require legal analysis. Do not assume an internal grievance suspends prescription. Appeals and other procedural steps can have much shorter deadlines.
Common mistakes to avoid
- Assuming probationary employees have no labor rights.
- Treating a contract label as conclusive proof of employment status.
- Using an outdated wage rate or confusing regular holidays with special nonworking days.
- Ignoring a notice to explain because the accusation seems unfair.
- Resigning before documenting alleged pressure or obtaining advice.
- Signing a quitclaim without checking the computation and scope of release.
- Assuming every complaint belongs before the same office.
Frequently asked questions
Do I have rights without a written employment contract?
Potentially, yes. Lack of a written contract does not by itself eliminate an employment relationship. Evidence of the actual work arrangement is important.
Can I resign immediately?
The ordinary rule under Article 300, formerly Article 285, requires written notice at least one month in advance. The law permits resignation without notice for specified just causes, including serious insult, inhuman or unbearable treatment, and certain crimes by the employer or representative. Whether an exception applies depends on the facts. lawphil.net
Do all resigning employees receive separation pay?
No. Voluntary resignation does not ordinarily create a statutory separation-pay entitlement. A contract, CBA, company policy, or applicable benefit arrangement may provide otherwise. Final pay is a separate matter.
When must final pay and a certificate of employment be released?
Under Labor Advisory No. 06, series of 2020, final pay should generally be released within 30 days after separation or termination, unless a more favorable policy or agreement applies. A certificate of employment should be issued within three days of the employee’s request.
Final pay includes amounts actually due, such as unpaid salary, proportionate 13th-month pay, and applicable leave conversion. Separation or retirement pay is included only when the employee is entitled to it. DOLE reiterated these requirements in its January 2026 guidance. Department of Labor and Employment
Does signing a handbook mean I accepted every provision as lawful?
No. An acknowledgment can establish receipt or awareness, but enforceability still depends on the law and the circumstances. Obtain a copy before signing and retain the version supplied.
